$ 1.5 Million Accord In Fatal-Fall Action

A SETTLEMENT of nearly $ 1.5 million was reported in a suit arising from the death of a 37-year-old construction worker who fell through an unguarded opening on a second-floor decking.
The settlement with the estate of Wieslaw Czygier occurred after Rockland Supreme Court Justice William E. Sherwood had granted it summary judgment on liability, according to the plaintiff's attorney, Herbert L. Waichman of Parker Waichman Alonso LLP. The construction company, K. Hovnanian of Northern Westchester and third-party defendant Motz & Buhl were represented, respectively, by Clifford Platt of Wilson, Elser, Moskowitz, Edelman & Dicker and Barry Ruderman of Garbarini & Scher.
