Building-Fall Action Settled for $ 1.2 Million

A 37-year-old painter injured after falling off a makeshift scaffold while working on a City Housing Authority building has settled his suit for $ 1.2 million.
The claims brought under Labor Law § 240 by Orlando Cruz,
who fractured a wrist and two vertebrae in the 40-feet fall two
years ago, were settled late last month before jury selection was
to begin in the Southern District of New York before Judge Lewis
A. Kaplan. The accident occurred at a housing project at 99 Fort
Washington Avenue in upper Manhattan.
The plaintiff was represented by Herbert L. Waichman of Parker &
Waichman of Great Neck; the HOusing Authority by Charles O'Bryan
of Gorayev & Cuyler.
